Abstract: In recent years, there has been an increased legal, scientific, and regulatory interest in how employers consider a job applicant’s criminal history and credit history when making employment decisions. This presentation will begin with a discussion of why employers conduct background checks, move to a review of the relevant case law pertaining to the use of applicants’ criminal and credit history, and finish with a discussion of methods to “validate” background checks. To spice things up, audience opinion will be sought on such controversial topics as:

  *   Are job-relatedness and business necessity the same thing?
  *   Is adverse impact determined at the overall background screen level or must it be shown for each element of the background screen (e.g., each crime, each exclusionary period)?
  *   Are all ex-cons the same or does job-relatedness/business necessity depend on the specific crime?
  *   Would Judge Judy agree with the EEOC?

Speaker Bio: Mike Aamodt is a Principal Consultant for DCI Consulting Group. He spends most of his days conducting salary equity analyses, computing adverse impact statistics, and helping develop employee selection systems for federal contractors and other organizations. Prior to working for DCI, Mike spent 26 years as a professor of Industrial/Organizational Psychology at Radford University. He received his B.A. in psychology from Pepperdine University in Malibu, California and both his M.A. and Ph.D. from the University of Arkansas.

Mike has published several books in the human resource area, published over 50 research articles in professional journals and presented over 125 papers at professional conferences.

In over 30 years as a trainer and consultant, Mike has helped a wide variety of organizations deal with such issues as compensation, employee selection, job analysis, performance evaluation, and downsizing.  He is considered one of the nation’s experts in police psychology and in OFCCP/EEOC compliance.

Mike is active in a variety of professional organizations.  He is a past president of the New River Valley SHRM as well as a past president of the Society for Police and Criminal Psychology.

In his spare time, Mike likes to make lame attempts at being athletic, cook what at times turn out to be edible meals, travel, and SCUBA dive.  He lives in Pulaski, Virginia with his wife Bobbie. Their son, Josh, is an attorney in Northern Virginia but Mike and Bobbie continue to love him anyway.
