The Limits of School Authority

Public schools can censor student speech that "materially disrupts" the educational activities of the school or that is inconsistent with school policies on drug use or "civility." But what authority, if any, do they have when a student makes a Facebook page or a YouTube video off campus that trashes another student -- or a teacher or administrator? Courts around the country have faced this question, with mixed results. Two panels of the Third Circuit issues opinions on this issue on the same day -- giving wildly varying answers. Come hear about the emerging law in this area, along with insights from a scholar who studies social media and a school administrator who handles these issues on the ground.

Acting Associate Director of OCAP


Megan Thompson, an alumna of the University of Oregon School of Law, is acting associate director of OCAP this year while the director is on sabbatical. Thompson clerked for Judges Ted Goodwin Milan Smith and on the U.S. Court of Appeals for the Ninth Circuit and for Judge David Schuman on the Oregon Court of Appeals. This fall she is teaching Civil Procedure. Next spring she will teach Children and the Law and Advanced Appellate Advocacy.
