Title: A Primer on Assessing EEO Risk: Understanding Contemporary Analyses of Disparity

Abstract: Employment decision processes are always made in the context of equal employment opportunity. These decisions may relate to hiring, promotion, termination, pay, and other scenarios that produce positive outcomes for some candidates and negative outcomes for others.   The policies and processes used to make these decisions may be alleged to discriminate against members of protected groups in a number of ways. This situation is only complicated by the fact that many procedures for making high-stakes decisions in organizations that are intended to measure job-relevant characteristics also produce significant and sizable subgroup differences. There are a variety of ways to measure disparities associated with EEO risk, yet each has strengths and weaknesses. Few of these approaches are frequently seen in actual enforcement. This presentation will review contemporary practices related to assessing EEO risk across a variety of policies and procedures, describe the strengths and weaknesses of various approaches, and recommend best practices.


Speaker Bio: Eric M. Dunleavy, Ph.D., is a Principal Consultant at DCI Consulting Group, where he is involved in equal employment opportunity audit and litigation consulting. He also serves on staff with the Center for Corporate Equality (CCE). Eric’s primary areas of expertise are in employee selection, employment testing, validation research, adverse impact analyses and other quantitative methods. His most recent work has focused on advanced quantitative analyses for assessing adverse impact and on selection procedure validation research in the context of OFCCP enforcement.

Dr. Dunleavy received his M.A. and Ph.D. in Industrial-Organizational Psychology with a concentration in quantitative analysis from the University of Houston. Eric has served as President, Vice President, and Legal Chair of the Personnel Testing Council of Metropolitan Washington, D.C. (PTC/MW) and is on the Editorial Board of the Industrial-Organizational Psychologist (TIP), where he co-authors the “On the Legal Front” column. In 2011 Dr. Dunleavy received the first Distinguished Early Career Contributions Award – Practice award from the Society for Industrial-Organizational Psychology (SIOP). He is currently on a SIOP task force responsible for providing contemporary selection recommendations to the Equal Employment Opportunity Commission (EEOC). 

Eric is currently adjunct faculty at both George Mason University and at the University of Maryland at Baltimore County, where he has taught graduate courses in multivariate statistics, applied measurement, and legal/ethical issues.
